{"id":909,"date":"2018-12-29T21:15:01","date_gmt":"2018-12-29T21:15:01","guid":{"rendered":"http:\/\/martalazaro.com\/?p=909"},"modified":"2018-12-29T21:15:04","modified_gmt":"2018-12-29T21:15:04","slug":"aprobada-la-convencion-de-naciones-unidas-sobre-mediacion","status":"publish","type":"post","link":"http:\/\/martalazaro.com\/?p=909","title":{"rendered":"APROBADA LA CONVENCION DE NACIONES UNIDAS SOBRE MEDIACION"},"content":{"rendered":"\t\t<div data-elementor-type=\"wp-post\" data-elementor-id=\"909\" class=\"elementor elementor-909 elementor-bc-flex-widget\">\n\t\t\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-1d61d377 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"1d61d377\" data-element_type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-edae149\" data-id=\"edae149\" data-element_type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-274ba41a elementor-widget elementor-widget-text-editor\" data-id=\"274ba41a\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><img decoding=\"async\" data-attachment-id=\"911\" data-permalink=\"http:\/\/martalazaro.com\/?attachment_id=911\" data-orig-file=\"https:\/\/i0.wp.com\/martalazaro.com\/wp-content\/uploads\/2018\/12\/gen_vic-homepage_cropped.jpg?fit=960%2C303&amp;wsr\" data-orig-size=\"960,303\" data-comments-opened=\"1\" data-image-title=\"gen_vic-homepage_cropped\" data-image-description=\"\" data-image-caption=\"\" data-large-file=\"https:\/\/i0.wp.com\/martalazaro.com\/wp-content\/uploads\/2018\/12\/gen_vic-homepage_cropped.jpg?fit=640%2C202&amp;wsr\" data-recalc-dims=\"1\" class=\"aligncenter size-medium wp-image-911\" src=\"https:\/\/i0.wp.com\/martalazaro.com\/wp-content\/uploads\/2018\/12\/gen_vic-homepage_cropped.jpg?resize=412%2C121\" alt=\"\" width=\"412\" height=\"121\" \/><br \/>El pasado d\u00eda 20 de diciembre la Asamblea General de Naciones Unidas aprob\u00f3\u00a0 la Convenci\u00f3n de las Naciones\u00a0 Unidas sobre los Acuerdos de Transacci\u00f3n Internacionales resultantes de la Mediaci\u00f3n.<\/p><p>Tal y como ha sido aprobado por la Asamblea General la Convenci\u00f3n a partir de la ceremonia de firma que se llevar\u00e1 a cabo el pr\u00f3ximo d\u00eda 7 de agosto en Singapur, los pa\u00edses que as\u00ed lo deseen podr\u00e1n adherirse a dicha Convenci\u00f3n internacional denominado \u201c<span style=\"color: #993366;\"><strong><em><a href=\"http:\/\/CONVENCION SINGAPUR NACIONES UNIDAS\" target=\"_blank\" rel=\"noopener\" data-wplink-url-error=\"true\"><span style=\"color: #993366;\">TEXTO CONVENCION SINGAPUR NACIONES UNIDAS<\/span><\/a><\/em><\/strong><\/span>\u201d<\/p><p>Hasta la aprobaci\u00f3n de la Convenci\u00f3n, los m\u00e1s citadas trabas para el uso de la mediacion era la necesidad de una eficiente y una armonizada regulaci\u00f3n legal para la ejecuci\u00f3n transfronteriza tanto de los acuerdos de sometimiento a mediacion de las controversias como de los propios acuerdos adoptados tras el proceso de mediacion.<\/p><p>En respuesta a esta necesidad la Convenci\u00f3n ha sido desarrollada y aprobada por la Asamblea General de Naciones Unidas.<\/p><p>La Convenci\u00f3n asegura que el acuerdo alcanzado por las partes ser\u00e1 vinculante y ejecutable de acuerdo con el sencillo procedimiento previsto en la misma. As\u00ed mismo\u00a0 la Convenci\u00f3n procurar\u00e1 una regulaci\u00f3n internacional de la mediacion uniforme y eficaz similar a la regulaci\u00f3n que el Convenio de Nueva York ha supuesto de forma exitosa desde los \u00faltimos 60 a\u00f1os para el reconocimiento y la efectividad de los laudos de arbitraje internacional.<\/p><p>La Convenci\u00f3n ha sido dise\u00f1ada para que sea un instrumento esencial para facilitar el comercio internacional y la promoci\u00f3n de la mediacion como un m\u00e9todo alternativo y efectivo para resolver controversias en el \u00e1mbito mercantil internacional. Tambi\u00e9n contribuir\u00e1 para fortalecer el acceso a la justicia y a su desarrollo legislativo por parte de los pa\u00edses firmantes.<\/p><hr \/><p>2018\u5e7412\u670820\u65e5\uff0c\u8054\u5408\u56fd\u5927\u4f1a\u901a\u8fc7\u4e86\u300a\u8054\u5408\u56fd\u5173\u4e8e\u8c03\u89e3\u4ea7\u751f\u7684\u56fd\u9645\u548c\u89e3\u534f\u8bae\u516c\u7ea6\u300b\uff08\u4e0b\u79f0\u201c\u516c\u7ea6\u201d\uff09\u3002\u7ecf\u5927\u4f1a\u6388\u6743\uff0c\u8be5\u516c\u7ea6\u5c06\u4e8e2019\u5e748\u67087\u65e5\u5728\u65b0\u52a0\u5761\u4e3e\u884c\u7684\u7b7e\u7ea6\u4eea\u5f0f\u4e0a\u5f00\u653e\u4f9b\u5404\u56fd\u7b7e\u7f72\uff0c\u5e76\u5c06\u88ab\u79f0\u4e3a\u201c\u65b0\u52a0\u5761\u8c03\u89e3\u516c\u7ea6\u201d\u3002<\/p><p>\u5728\u516c\u7ea6\u901a\u8fc7\u4ee5\u524d\uff0c\u8c03\u89e3\u7684\u4f7f\u7528\u9762\u4e34\u7684\u4e00\u9879\u6700\u5e38\u89c1\u7684\u6311\u6218\u662f\uff0c\u7ecf\u8c03\u89e3\u4ea7\u751f\u7684\u548c\u89e3\u534f\u8bae\u5728\u8de8\u5883\u6267\u884c\u65f6\u7f3a\u4e4f\u4e00\u4e2a\u6709\u6548\u4e14\u7edf\u4e00\u7684\u6846\u67b6\u3002\u9488\u5bf9\u6b64\u9700\u8981\uff0c\u8054\u5408\u56fd\u5927\u4f1a\u5236\u5b9a\u5e76\u901a\u8fc7\u4e86\u8be5\u516c\u7ea6\u3002<\/p><p>\u516c\u7ea6\u786e\u4fdd\u4e86\u5f53\u4e8b\u5404\u65b9\u8fbe\u6210\u7684\u548c\u89e3\u534f\u8bae\u80fd\u591f\u4f9d\u636e\u7b80\u6d01\u89c4\u8303\u7684\u7a0b\u5e8f\u5177\u6709\u7ea6\u675f\u529b\u548c\u6267\u884c\u529b\u3002\u516c\u7ea6\u4e3a\u8c03\u89e3\u63d0\u4f9b\u4e86\u4e00\u4e2a\u7edf\u4e00\u6709\u6548\u7684\u6846\u67b6\uff0c\u7c7b\u4f3c\u4e8e\u300a\u7ebd\u7ea6\u516c\u7ea6\u300b\u5728\u8fc7\u53bb60\u5e74\u4e2d\u6210\u529f\u5730\u4e3a\u5916\u56fd\u4ef2\u88c1\u88c1\u51b3\u7684\u627f\u8ba4\u548c\u6267\u884c\u6240\u63d0\u4f9b\u7684\u6846\u67b6\u3002<\/p><p>\u516c\u7ea6\u65e8\u5728\u6210\u4e3a\u4fc3\u8fdb\u56fd\u9645\u8d38\u6613\u548c\u63a8\u5e7f\u8c03\u89e3\u4f5c\u4e3a\u4e00\u79cd\u6709\u6548\u7684\u66ff\u4ee3\u6027\u4e89\u8bae\u89e3\u51b3\u65b9\u5f0f\u7684\u91cd\u8981\u5de5\u5177\uff0c\u5e76\u6709\u52a9\u4e8e\u52a0\u5f3a\u516c\u5e73\u548c\u6cd5\u6cbb\u7684\u5b9e<\/p><p><\/p><\/div><\/div><\/div><\/div><\/div><\/section><\/div> <a href=\"http:\/\/martalazaro.com\/?p=909#more-909\" class=\"more-link elementor-more-link\"><span aria-label=\"Sigue leyendo APROBADA LA CONVENCION DE NACIONES UNIDAS SOBRE MEDIACION\">(m\u00e1s&hellip;)<\/span><\/a>","protected":false},"excerpt":{"rendered":"<p>El pasado d\u00eda 20 de diciembre la Asamblea General de Naciones Unidas aprob\u00f3\u00a0 la Convenci\u00f3n de las Naciones\u00a0 Unidas sobre los Acuerdos de Transacci\u00f3n Internacionales resultantes de la Mediaci\u00f3n.
